OVERVIEW
This agreement outlines the services and terms of use of Tickit, an online ticket sales system created by Tickit Event Services.
Tickit provides online ticket sales for events. Buyers use a secure public website to buy tickets to events. Their payment is processed by the Tickit system and digital tickets in PDF format are issued.
Sellers use Tickit’s secure private administration website to set up tickets for sale, download sales reports and manage sales.
Tickit also provides check-in software for use at event entry points by way of ticket holder name search or ticket barcode scanning via third party scanning devices. This software runs on computers with an up-to-date version of Google Chrome or Internet Explorer or a modern Apple or Android mobile device.
SECURITY
All connections to the Tickit system are encrypted over a minimum 128 bit secure connection, using a secure certificate set up by Tickit on the seller’s behalf. Daily offsite backups are made of all sales data to reduce the impact of any potential service disruption. Buyer credit card numbers and verification codes are not stored or logged anywhere in the Tickit system.
The seller’s access to the Tickit administration area is secured with a password that the seller is responsible for keeping secret.
FEES AND PAYMENT
Tickit adds a service fee to each ticket sold through the system. This fee is automatically calculated based on the price of the ticket, before tax. The current fees are listed at https://tickit.ca/pricing. Some accounts may have different fees based on premium contract terms.
For sellers using Stripe payment processing fees are collected directly at time of purchase.
For sellers using other payment processors, Tickit’s fee is included in the amount deposited directly into the seller’s merchant account. Tickit invoices the seller fees monthly, net 30, with interest on overdue accounts charged at 24% per year (2% per month).
In the event that the seller is more than two months in arrears on fee payment, Tickit reserves the right to disable both public and administrative access to the system.
Tickit reserves the right to invoice for outstanding fees (due immediately) seven days prior to the seller’s event. In the event of non-payment, Tickit reserves the right to disable both public and administrative access to the system.
REFUNDS
Tickit fees will be refunded when a payment is refunded up to a maximum of 10% of the tickets sold for a given event (by number of tickets sold). The seller remains responsible for the fees when more than 10% of the tickets sold are refunded (e.g. cancellation of an event).
CONTENT
The seller is responsible for ensuring they have legal rights to use any content they upload to their Tickit store.
LIABILITY
Tickit services are sold “as is” in all circumstances. Tickit’s maximum liability in all cases is limited to the fees collected. Tickit is not responsible for any lost data, lost profits or business interruption. The seller is responsible for ensuring that their event complies with all relevant laws. The seller agrees to indemnify and hold Tickit harmless in the event of any legal action resulting from their event or the content they upload to the site.
TERM AND TERMINATION
This agreement may be terminated by either party at any time, effective immediately upon notice in writing.
JURISDICTION
The laws of British Columbia, Canada govern this agreement.
SEVERABILITY
If any part of this agreement is found invalid or unenforceable the remainder of this agreement remains in effect.
ALTERNATIVE DISPUTE RESOLUTION
In the event of any dispute between you and us in relationship to the work discussed here, we will make good faith efforts to resolve those differences, and if necessary engage a facilitator or mediator to help us to resolve those differences, without prejudice to our contractual rights and remedies arising from this agreement. Any facilitation or mediation costs will be shared equally between us for this purpose.
